Villkor

1. Tolkning

I dessa försäljningsvillkor (nedan kallade ”villkoren”):

”Avtal” avser ett avtal mellan oss och dig för leverans av varor som upprättas vid ditt skriftliga godkännande av vår offert eller på annat sätt genom ett skriftligt eller muntligt avtal mellan oss och dig, inklusive dessa villkor och eventuella särskilda villkor,

”Varor” avser produkter som överenskommits i avtalet och som ska levereras till dig av oss,

Med ”särskilda villkor” avses alla särskilda villkor som rör leverans av varor till dig och som ingår i eller hänvisas till i vår offert eller på annat sätt framställs i ett skriftligt avtal mellan oss och dig. Om det finns en konflikt mellan dessa villkor och de särskilda villkoren ska de särskilda villkoren gälla,

”Vi/oss” avser Kenwood Limited (företagsregistreringsnummer 0872044) som har verksamhet på New Lane, Havant, Hampshire, PO9 2NH, och

”Du/din” avses den person, firma eller det företag som köper varorna från oss

2. WHAT PERSONAL DATA WE COLLECT

We collect the following categories of personal data (hereinafter “Personal Data”):

●        Contact Data – Information on your name, nickname, surname, address, mobile telephone number, email address, account ID or name, and passwords.

●        Favorited Content – Information that interests you, for example articles and products you select as “Favorite”.

●        Social Media Data – Any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with the Company. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you interact with the Company through a third party social network or if you login in our websites or app through your Social Media accounts. To learn more about how your information from a third party social network is obtained by, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.

●        Device Technical Data – Technical information related to the devices that you use to access the App, such as your operating system, country, and time zone.

●        Coffee Machine Data - Technical information related to the specific De’Longhi coffee machine you pair with the App, including the Internet Protocol (IP) address of your machine.

●        Mobile Permissions for Personal Data access – Information useful to access your mobile device’s storage capabilities, sensors or other features (e.g. Wi-Fi, geo-location, Bluetooth, camera). 

●        Use of the App  Information on your App usage, including your session, login and authentication information.

3. ANALYTICS

We use analytics to operate, provide, improve, understand and customize our services. The analytics allow us to recognize your mobile device and collect information and personal data including your unique user device number, the IP address of your mobile device, the type of mobile internet browser or operating system you use, session and usage data, or service-related performance information, which is information about your use of the App. Based on your mobile device’s IP address and SIM card carrier information we can show you country specific content (including information in your local language).

To give you a more personalized experience, we process your analytics data to show you the right content and send you recommendations, In-App messages and Push Notifications (if you decide to allow this in the App settings).

Currently these are the third-party analytics the App uses:

-          Google Firebase. This App uses Google Firebase, an app development service (“Firebase”) provided by Google Ireland Ltd. (“Google”). Firebase uses “cookies” or similar techniques, which are text files placed in your App and web browser. On behalf of De’Longhi, Firebase will use information from your mobile device such as your device ID, IP address, your IDFA or Google Play Services ID and your MAC address, and replace them with a unique code. When you use the App we will measure the numbers of visits to the App, which pages you visit, your network connection, load times and when the App crashes. We use this information to evaluate and understand your use of the App, to test and analyze performance and ultimately optimize our products and services. 

-          Salesforce Marketing Cloud Mobile Push. This App uses Salesforce Marketing Cloud Mobile Push, a push notifications and digital marketing service provided by Salesforce Inc. (“Salesforce”). When you use the App we will send you push notifications for service and marketing purposes. We will also track some of the App pages you visit in order to optimize the content of the push notifications you will receive.

Please note that we only process your analytics information after you have provided consent.

4. Consegna

4.1 I tempi di consegna non saranno essenziali per il Contratto e qualsiasi data di consegna fornita sarà solo una stima. Ci riserviamo il diritto di estendere i tempi di consegna per periodi ragionevoli se il ritardo è dovuto a un evento al di fuori del nostro ragionevole controllo (un “evento di forza maggiore”).

4.2 Qualora l’Utente necessiti di una comunicazione anticipata del tempo approssimativo di consegna, tale comunicazione dovrà essere riportata per iscritto nell’ordine dell’Utente.

4.3 Il luogo di consegna sarà il luogo abituale in cui si svolge la Sua attività.

4.4 Se per qualsiasi motivo l’Utente non accetta la consegna di Merci quando sono pronte per la consegna, o se non siamo in grado di consegnare le Merci in tempo perché l’Utente non ha fornito istruzioni di consegna appropriate o altre informazioni, allora in quel momento:

(a) il rischio di tali Merci passerà all’Utente;

(b) le Merci saranno considerate consegnate;

(c) Possiamo conservare le Merci fino alla consegna effettiva, nel qual caso l’Utente sarà responsabile di tutti i costi e le spese correlati (inclusi, a titolo esemplificativo ma non esaustivo, lo stoccaggio e l’assicurazione); e

(d) il prezzo pieno per le Merci unitamente a qualsiasi somma da applicare ai sensi della Clausola 3.2 diventerà immediatamente esigibile.

4.5 La nostra responsabilità per la mancata consegna delle Merci sarà limitata alla ri-consegna delle Merci entro un tempo ragionevole o all’emissione di una nota di credito a fronte di qualsiasi fattura generata per tali Merci.

4.6 Fatte salve le altre disposizioni delle presenti Condizioni, non saremo responsabili di alcuna perdita (inclusa la perdita di profitto), costi, danni, oneri o spese causati direttamente o indirettamente da qualsiasi ritardo nella consegna delle Merci, né alcun ritardo darà diritto all’Utente di risolvere o rescindere il Contratto a meno che tale ritardo non superi centottanta (180) giorni.
